341 Meeting of Creditors
The "Meeting of Creditors" is covered in §341 of the United States Bankruptcy Code. It can be called by lots of names and be a very difficult meeting for you. You will have to attend a 341 Meeting or a Meeting of Creditors in either Chapter 7 Bankruptcy or Chapter 13 Bankruptcy. The Meeting of Creditors is held about six weeks after the filing of your Bankruptcy Petition in the United States Bankruptcy Court.
This meeting seems intimidating and can make or break your case. In most instances this meeting comes off without a hitch. The meeting is attended by you and your attorney as well as a Trustee appointed by the court. The Trustee is simply the judge's helper, but he or she is the most powerful person in your case. The Trustee has the right to object to your discharge as well as take any assets that are not exempt or protected. It is important to have your bankruptcy lawyer attend this meeting with you. A Bankruptcy Attorney is an important ally at this point in your bankruptcy filing.
